Privacy Policy

Cancelux understands the importance of consumer privacy. This Privacy Policy explains how we collect, use, and protect any personal information shared through this platform.

We encourage you to read through this Privacy Policy carefully to understand what information is collected, how it is used, and the choices available to you regarding your data. Should you have any questions or need further clarification, please feel free to reach out.

For easy reference, please see the table of contents below, outlining the main sections of this Privacy Policy.

Article 1 - Definitions

Cancelux: Refers to our organization, which offers subscription termination services and is responsible for handling your personal data under this Privacy Policy. Throughout this document, we may also use "We" or "Us" to refer to Cancelux.

Consumer: Any natural person interacting with Cancelux or utilizing Cancelux's services.

Provider: The company or organization with which you hold a subscription that you wish to cancel.

Services: The range of options available to consumers through Cancelux, including for cancelling subscriptions through Cancelux, also known as "termination services."

Personal Data: Information that can reasonably identify you, such as your name, address, email, date of birth, and any customer or membership identifiers.

Article 2 - Introduction

Our use of your information is strictly limited to providing our termination services or otherwise providing you support when using our services, including the creation and dispatch of termination letters.

Data minimization is important to us; we only retain information essential for drafting your termination letter and for the duration necessary to fulfill our service obligations or as otherwise required by law. Any data, including signatures contained within termination letters, is automatically purged from our system when we no longer need it to provide the Services.

For full transparency and control over your data, we welcome any inquiries or requests for correction or deletion. Please feel free to reach out to us through the contact details listed in our privacy policy. Should you object to any data processing based on legitimate interest, we respect your right to do so.

GDPR Compliance for European Users:

While Cancelux also operates under U.S. regulations, we are committed to protecting the privacy and data of our users in European countries in accordance with the General Data Protection Regulation (GDPR). The GDPR, effective since May 25, 2018, aims to protect the privacy and personal data of individuals within the EU and the European Economic Area (EEA). It sets guidelines for how organizations handle personal data, emphasizing principles such as lawfulness, fairness, transparency, data minimization, and accountability.

Under the GDPR, you have specific rights regarding your personal data, including the right to access, rectify, erase, restrict processing, data portability, and object. If you are a European user and wish to exercise any of these rights, please contact us at [email protected].

For more information about the GDPR and your rights, please visit the official GDPR website here.

Article 3 - Data Storage and Retention

Cancelux prioritizes the security and responsible handling of your personal data above all. We store your information on secure servers or in cloud environments that adhere to recognized privacy and security standards. Your personal data is retained only for the duration necessary to serve its intended purposes, including facilitating subscription termination services and meeting legal obligations.

Following our retention period, we securely erase or anonymize personal data, so it cannot be linked back to you. We may retain personal data longer if required by law. Should you request the deletion of your data before this period ends, we will comply unless legally required to retain it. You can request the deletion of your data by contacting us at [email protected].

Providing personal data is not a legal or contractual requirement, nor is it mandatory to use our services. However, not providing it may limit your ability to fully engage with our services or website functionalities.

Article 4 - Security of Personal Data

At Cancelux, we employ state-of-the-art technical and organizational measures to safeguard your personal data against loss, unauthorized access, misuse, or disclosure. Access to your information is strictly confined to personnel who require it for their work, all of whom are obligated to maintain confidentiality per our data protection policies.

We leverage advanced encryption and firewall technologies to protect your data during transmission and storage, ensuring it remains secure through controlled, secure environments. Our commitment to data security means we continually update our practices in line with the latest advancements and best practices in the field.

Article 5 – Data Collection and Use of Our Termination Services

During your visits to our website, Cancelux collects specific technical data automatically to enhance and secure your online experience. This data includes:

  •  Visit Information: The date, time, and length of your website visit, along with the duration of your internet connection. Analyzing this data allows us to improve our site's performance and user experience.
  • Referral Source: The URL of the site you came from helps us understand which channels effectively draw visitors to our site.
  • Operating System: Identifying whether you use Windows, macOS, iOS, Android, or another system enables us to optimize our website for compatibility and performance across devices.
  • Browser Information: Collecting data on your browser type and version (e.g., Google Chrome, Mozilla Firefox) ensures our website functions correctly on your device.
  • IP Address: Recording your device's IP address, a unique identifier assigned during internet access, assists in geolocation and safeguards our systems.

This technical information is used internally for website management, usage analysis, technical support, and security. It is stored temporarily, with stringent measures in place to protect its confidentiality and integrity in line with our data protection policy and legal standards.

On our website, we provide a service for generating notices to terminate various services and subscriptions. For us to create these notices, we need to collect some information from you:

  • First and last names
  • The street address and number
  • Zip code
  • City or town
  • Email address
  • Customer or membership number, or any other identifier provided by the service provider

This personal information is used exclusively for drafting, creating, and sending out your termination letter. The collection and use of this data are crucial for us to deliver the termination services effectively.

We also log the time when the termination letter is generated and the IP address from which the request was made. This practice helps us prevent and identify any misuse of our services, ensuring the integrity and lawful use of our platform.

If you opt to send the termination letter directly to the service provider, the necessary information you've provided will be shared with them as well as with our web hosting service to facilitate this process.

We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

  • Receiving help through our customer support channels;
  • Participation in customer surveys or contests; and
  • Facilitation in the delivery of our Services and to respond to your inquiries.

Providing your personal information is not a legal requirement, but it is necessary for the proper functioning of our termination services. Although you're not obliged to share your personal data, failure to do so might prevent us from creating an accurate termination letter for you.

Article 6 - Payments

For our services, we accept a variety of payment methods including credit cards, PayPal, and others. We do not store your payment information. For financial transactions, we partner with established payment processors that adhere to stringent security protocols. When you make a payment, the payment provider (depending on the payment method you choose) will handle the following data:

  • Payment details, such as your credit card number or PayPal account information
  • Your IP address
  • Information about your internet browser and device
  • Occasionally, your first and last names, address details, or information regarding the products or services you've purchased from us
  •  Any other personal information you provide to us, for example, through customer service inquiries

This data is processed to review your payment, finalize the service agreement, and manage your transaction. We retain this information only as long as necessary to complete your order and fulfill any applicable legal requirements regarding data retention.

Providing your personal data is crucial for the establishment of a service contract with us. Without this information, we are unable to proceed with finalizing the contract or providing the services you request.

Article 7 - Cookies

What are cookies?

Cookies are small data files that are placed on your computer or mobile device when you visit a website. Cookies are widely used by website owners in order to make their websites work, or to work more efficiently, as well as to provide reporting information.

Cookies set by the website owner (in this case, Cancelux) are called "first-party cookies." Cookies set by parties other than the website owner are called "third-party cookies." Third-party cookies enable third-party features or functionality to be provided on or through the website (e.g., advertising, interactive content, and analytics). The parties that set these third-party cookies can recognize your computer both when it visits the website in question and also when it visits certain other websites.

Why do we use cookies?

We use first- and third-party cookies for several reasons. Some cookies are required for technical reasons in order for our Website to operate, and we refer to these as "essential" or "strictly necessary" cookies. Other cookies also enable us to track and target the interests of our users to enhance the experience on our Online Properties. Third parties serve cookies through our Website for advertising, analytics, and other purposes. This is described in more detail below.

How can I control cookies?

You have the right to decide whether to accept or reject cookies. You can exercise your cookie rights by setting your preferences in the Cookie Consent Manager. The Cookie Consent Manager allows you to select which categories of cookies you accept or reject. Essential cookies cannot be rejected as they are strictly necessary to provide you with services.

The Cookie Consent Manager can be found in the notification banner and on our website. If you choose to reject cookies, you may still use our website though your access to some functionality and areas of our website may be restricted. You may also set or amend your web browser controls to accept or refuse cookies.

The specific types of first- and third-party cookies served through our Website and the purposes they perform are described in the table below. (Please note that the specific cookies served may vary depending on the specific Online Properties you visit.):

Article 8 - U.S. State Rights

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

We only collect sensitive personal information, as defined by applicable privacy laws or the purposes allowed by law or with your consent. Sensitive personal information may be used, or disclosed to a service provider or contractor, for additional, specified purposes. You may have the right to limit the use or disclosure of your sensitive personal information. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you.

Selling or Sharing Information

We have not sold or shared (as defined by privacy laws) any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

Your Rights

You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

  • Right to know whether or not we are processing your personal data
  • Right to access your personal data
  • Right to correct inaccuracies in your personal data
  • Right to request the deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us
  • Right to non-discrimination for exercising your rights
  • Right to opt out of the processing of your personal data if it is used for targeted advertising (or sharing as defined under California’s privacy law), the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects ("profiling"). Please note we do not engage in these activities at this time.

Depending upon the state where you live, you may also have the following rights:

  • Right to obtain a list of the categories of third parties to which we have disclosed personal data (as permitted by applicable law, including California's and Delaware's privacy law)
  • Right to obtain a list of specific third parties to which we have disclosed personal data (as permitted by applicable law, including Oregon’s privacy law)
  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California’s privacy law)
  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature

How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at [email protected], by visiting https://cancelux.com/en-us/contact, or by referring to the contact details at the bottom of this document.

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent who does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

If we deny your rights request, you have the right to request an appeal of our decision. To initiate an appeal, follow the instructions provided in the communication denying your request, or contact us at the information provided in this Privacy Policy.

We will respond to rights requests in the time periods allowable by law.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.

California Online Privacy Protection Act

CalOPPA requires us to let you know how we respond to web browser Do Not Track (“DNT”) signals. DNT is a privacy preference you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page. For details, including how to turn on DNT, see here. Because there currently isn’t an industry or legal standard recognizing or honoring DNT signals, we don’t respond to them at this time.

Article 9 - Policy Amendments

We reserve the right to update or modify this Privacy Policy at any time. Changes will be posted on our website, so we encourage you to review our policy regularly to stay informed.

Article 10 - Contact Us

If you have any questions or concerns about our privacy practices or your personal data, please reach out to us at:

Article 11 - Data Deletion Requests

Every user has the right to request the deletion of their personal information at any time. If you wish to have your data removed from our systems, you can submit a request by contacting us via email at [email protected].

Upon receiving your data deletion request, we will take appropriate measures to securely erase your information from our records, provided there are no legal or operational reasons for retaining it.
